Ubuntu 9.04 menu problem(ASUS U81)

I found that this behavior can be avoided. In case user use the following
scenario

1. goto to a menu (e,g programming)
2. setup at least one item (e.g. Python) in this menu
3. in this case flag on menu is not reseted automatically.


So menu flag that responsible activating menu is reseted in case menu is
empty. Does this desined behavior?
