Intel 536 modem patch

I'm using hoary and trying to get my internal modem working, but
having an issue.

following this howto

but when attempting to apply the patch the terminal just throws:
patch: **** Only garbage was found in the patch input.

Any likely problems that could cause this, i've checked the code
through and it looks to be identical to that listed on the how to. Any
suggestions for things to check are as they should be?
