Yes. You are correct. By licensing under CC, the author of the work does
not, in any way, give up all of his rights to his work. This the reason
why CC is also know as "some rights reserved". Moreover, if there is a
need to make derivative works, it "can be waived if you get permission
from the copyright holder." [1]

TUSG, as the licensor, is not bound by the nd clause, so we are not
violating the terms. This is like the case of dual-licensing of
softwares such as MySql.
