What you mean by "working on a network share"?
Does you working on local disk checkout from remote machine,
or completely on remote machine that connected to some drive letter?

Actually pre-dirstate version that you're using should not have any locking problem,
IMHO. At least it should not be problem on commit. May be your repository
was locked... but I don't understand how you can successfully commit
revision info without files and without --unchanged flag.

I'm dogfooding on the same version and don't see anything similar.
