This error has been around for some time and has a couple of related
bug reports open in Launchpad. Could you try the following?

sudo mv /etc/X11/xorg.conf /etc/X11/xorg.conf.old
sudo nvidia-xconfig
gksudo nvidia-settings

This will backup the old X configuration file to xorg.conf.old,
nvidia-xconfig will generate a new file, and gksudo will start the
nvidia-settings program properly as root (since its a graphical
application).
