No. If you upgrade from 8.04 you keep grub legacy. If you upgrade from 
9.10 it depends which grub version you used with 9.10. Even though grub2 
is the default for 10.04, the upgrade process will preserve your current 
grub version. You only get grub2 if you do a fresh install of 9.10 or 
10.04 or if you manually upgrade your grub version.
