Converting ext3 to ext4 resulting in loss of data?

When I last looked at the installer so far as I can remember the GUI
says to format as X filesystem that you pick from and not 'label as'
...
Additionally after saying okay to that back on the main screen the
'format' box is force ticked and cannot be unticked if you have set a
format as X filesystem... but I *think* that the tick is greyed out as
it cannot be changed... and consequently might look like it is
unticked due to being very feint...
Of course this discussion (and potential bug?) might all be moot given
the new look Ubiquity installer in 10.10 ....
