max at max-laptop:~$ sudo mv /var/lib/dpkg/info/xorg-driver-fglrx.postrm 
/var/lib/dpkg/info/xorg-driver-fglrx.postrm.max

max at max-laptop:~$ sudo dpkg --purge xorg-driver-fglrx

then

sudo apt-get install xorg-driver-fglrx

reinstalled and whooops, problem solved.
