Someone there claims it is 'free as in speech', fails to back it up
with anything.
I found this on the debian-legal list:
<http://lists.debian.org/debian-legal/2006/03/msg00535.html>
(The DFSG is just Debian's view on what free means, but it was used as
the basis of the Open Source Definition)

export restrictions part. As far as I was aware Ubuntu do not filter
or restrict access to the packaging system based on country, would
Ubuntu be breaching the license agreement if someone from one of the
listed countries downloaded it, or would the person who downloaded it
just be in violation of the license.
As the license prohibits redistribution in that clause I would
personally count it as non-free.
Discriminating based on where one lives, that's low, what next Disney?
As always IANAL (I am not a lawyer).

It's very simple, from the Debian list I think it can be fixed by
doing the following:
- Remove the section about sending changes back (fails desert island test!)
- Remove the section prohibiting distribution based on country
- Remove the section about being under the jurisdiction of California
(this was discussed on the Debian legal list in March, still nothing
has been done about it.)
