thanks for that clarification, as agreed there is nothing to argue 
about, that GPL header doesn't matter in any way, it is an entirely moot 
point and was an irrelevant distraction, it is proprietary code and as 
such we now have no rights to use it and no further use for it. I for 
one am done talking about the old proprietary code, I am only interested 
in talking about new solutions which give the project software freedom.
