I can't speak for the phone developers, but considering the android kernel uses proprietary blob drivers for the video
already, it's a moot point.  It's also likely that the radio firmware (the stuff that connect to the telco) will be
closed, since (a) it's probably in the silicon and (2) most telcos won't allow user-serviceable parts to touch their
networks.

Any software developed by Canonical is committed to being GPLv3.  That includes the Unity 8 shell and core applications.
