Fresh installs of 9.10 or later use grub2, upgrades from installs older
than that still use grub legacy.  At any rate, the menu you posted
clearly shows kernel version 3.8.0-19-generic.

  In xubuntu 12.10 rc, the updated grub boot menu no longer shows what
  kernel version it is booting into for the first entry.
