[MERGE] Fix missing pending merges

Hi,

WorkingTree.pending_merges() was checking for the wrong exception. This
exception fixes this and adds a test. 

Modern checkouts, however, will always have a 'pending-merges' file. So
alternatively, this check could be removed altogether.
