What ubuntu destribution are you using?

This appears to be fixed in 0.5.35-2 (since Intrepid / hardy-backports).

nginx (0.5.35-2) unstable; urgency=low

  * debian/init.d: do not break if start-stop-daemon exits with an error.
    (Closes: #464453)
