The maintainer just said he believed he would merge that patch into the
next release. Good news, though I guess we will need to wait for at
least 23.04 to see it as standard in Ubuntu.
The patch isn't perfect - it protects all existing directories in the
target tree, rather than just the topmost one. So still a bit
counterintuitive, but good even so.
Big thanks to Wayne Davison (the maintainer) and Antti Tapaninen (who
wrote the initial patch).
