Failure to get fglrx to build using Maverick kernel (kernel ppa)

the fglrx monitors for new kernels and when you install a new one it
looks for the kernel headers and uses them. same for if you installed
every single kernel the normal repositories have available. its not
doing that for the kernel/ppa kernels.
