It's not possible with a mailing list.  Once I have received it there
is no way you can get onto my pc and change it.  At least I hope there
isn't.

By analysing the mode of failure I suppose they could say that it is
what they expect to find when it has been written to too many times.
It would be difficult for the customer to prove otherwise.  Of course
they *might* just replace it anyway as it is less hassle than to
fight.  Alternatively they might just have a standard reply that it is
worn out rather than faulty and wait for the customer to try and prove
otherwise.
