If Jay wants to use the windows bootloader to boot to 9.10 grub2, just
upgrading will result in not being able to boot up 9.10.
It would be highly improbable that he would be able to boot up even he
creates a new bin for the windows bootloader as the bin created may use
the old grub-legacy and menu.lst if he just upgrade to 9.10.
However it might be a different case if he clean install a new 9.10.
(and even then I am not sure).
Of course, what most of us here would just recommend that he sets his
grub to sda, and get rid of his windows mbr, but that is his call.
