It may come with source, but that doesn't mean that the source is "Free".
Does it come with a license that is compatible with the Linux kernel? If
it is, then it will probably already be in the most recent kernel. If it
doesn't come with a compatible license, then the kernel team isn't allowed
to use that particular implementation of the driver.
