This sounds like a bug in the filesystem itself, but /home is apparently
just part of an ext3 filesystem

Can you clarify?  Do you mean e.g.

/home/alain/secret is a symbolic link to /data/secret

or similar?

Okay, so you don't have a /home partition, meaning /home is part of /.
I'm really not sure what's going on.
