    Just to be picky, Apple's *iTunes Store* sells DRM encumbered AAC format 
audio.
AAC itself is a fairly open format, and supported by different manufacturers.
An iPod is currently the only hardware Apple is allowing to use the AAC DRM 
files.
The iPod itself is no better or worse than the majority of other hardware
solutions out there.  Getting your music back off of it is not allowed for in
the Apple iTunes interface, but easily enough done on any platform.
I don't think that's any different than the scads of hardware that play
Windows Media format.   Heck, mp3 is patent encumbered.
    Now, if you do want to support a company that encourages open formats,
and don't want to give your money to a company that uses DRM, 
then pick one that plays ogg and not DRM from either iTunes or MS I suppose.
