Of course! 10 gigabit over copper is a little tricky!

Sounds like it is an Ubuntu driver issue. I'd submit a bug via launchpad
to at least bring it to the notice of the developers.

Having said that I doubt there are many Ubuntu users out there using
this kind of kit!
