I'm not picking sides here, but I think the point she was trying to
make is that gaim is not "free" as in the "debian way", and while it
is unlikely that litigation will ever arise from AOL, it is a
possibility.

That being said, mp3 support is a surefire ticket to litigation.  I
believe mp3 support is being looked into for the Hoary Hedgehog
release.  I could be mistaken there though.
