apache2 SSL mpm-worker mod_fcgid Resource deadlock avoided

I'm having troubles similar to this bugreport

I'm using Ubuntu 14.04 amd64 Server

after a while even under non heavy server load you'll get [php-cgi]
<defunct> zombies which will never die until apache server restart

I've tried it with disabled mod_pagespeed, same problem

can anybody confirm this?
