This appears to be fixed in Lucid:

virsh # define /tmp/foo.xml 
Domain foo defined from /tmp/foo.xml

virsh # list --all 
 Id Name                 State
----------------------------------
  - foo                  shut off

virsh # define /tmp/foo.xml 
Domain foo defined from /tmp/foo.xml

virsh # list --all 
 Id Name                 State
----------------------------------
  - foo                  shut off
