[ubuntu-my] ISSUE: Canonical Permission for our domain http://ubuntu.com.my

Dear Friends,

Thanks for the information and reminder Mr. Zarul. I'm taking this issue
seriously so we can successfully settle this trademark stuff and won't have
any problems with Canonical later. So, we have a checklist now. And also we
have another issue to look before we got it "overlooked". Let us be the true
"Ubuntu community" and follow the code of conduct while working together.

Please refer to http://www.ubuntu.com/community/conduct

As what I understand from what Mr. Zarul said, his point is:

*1. Canonical prefer if the domain is to be registered under Canonical.
*
*2. During the application, prease remove all unrelated banners on our LoCo
website.*

*3. Read the policy again and check that we didn't miss a thing.*

That's all what I understand. Please correct me if I do missed out anything.

Now, let's go to my opinion and solution ideas:

1. We can take the Canonical's registered domain to solve the first issue.
Other domains will just our suggestion to them if they can allow us to use
it. If in case they don't allow the other domains (which is rarely happen in
our case), domain owners can simply sell it to them and get some money..
huhuhu. (you can 'belanja' me then)

2. Strictly, we should remove other non-Ubuntu related and commercial
banners in our LoCo website. Banners like the HITB announcement and so on
should be removed. All members can double or even triple check the website
for this issue and inform it here so Web Team can remove them later.

3. I'm reading the Trademark Policy
http://www.ubuntu.com/aboutus/trademarkpolicy and here's my quick digest.
Please if you guys have time, do re-read the policy and add points that I've
missed out. (I'm not so perfect anyway):

* Canonical owns a number of trademarks and these include UBUNTU, KUBUNTU,
EDUBUNTU, and XUBUNTU. The trademarks are registered in both word and logo
form. Any mark ending with the letters UBUNTU or BUNTU is sufficiently
similar to one or more of the trademarks that permission will be needed in
order to use it.

* The policy encompasses all marks, in word and logo form, collectively
referred to as "Trademarks".

* *Canonical share access to the Trademarks with the* *entire community* for
the purposes of discussion, development and advocacy. So, don't be afraid,
we are part of the community. Remember?

* The Trademark is used in a manner consistent with the Usage Guidelines
below

* There is *no commercial intent behind the use*

* Do not refer Ubuntu to something else that is not Ubuntu.

* There is no suggestion (through words or appearance) that your project is
approved, sponsored, or affiliated with Ubuntu or its related projects
unless it actually has been approved by and is accountable to the Ubuntu
Community Council

* things about remix product (unrelated to our loco)

* *Commentary and parody*. The Ubuntu trademarks are designed to cover use
of a mark to imply origin or endorsement by the project. When a user
downloads something called Ubuntu, they should know it comes from the Ubuntu
project. This helps Ubuntu build a reputation that will not be damaged by
confusion around what is, and isn't, Ubuntu. *Using the trademarks in your
discussion, commentary, criticism or parody, in ways that unequivocally do
not imply endorsement, is permissible*.

* *Anyone is free to write articles, create websites, blog about, or talk
about Ubuntu -- as long as it's clear to everyone -- including people
completely unfamiliar with Ubuntu -- that they are simply referring to
Ubuntu* and in no way speaking for Canonical, or the Ubuntu project.

* Canonical reserve the right to review all usage within the open source
community, and to object to any usage that appears to overstep the bounds of
discussion and good-faith non-commercial development.

** If we have gone commercial, we don't have the trademark right anymore.*

*So, why the hell do we need permission? Here's the answers:*

Permission from us is necessary to use any of the Trademarks under any
circumstances other than those specifically permitted above. These include:

   -

   Any commercial use
   -

Use on or in relation to a software product that includes or is built on
top of a product supplied by us, if there is any commercial intent
   associated with that product.
   -

   * Use in a domain name or URL.*
   -

   * Use for merchandising purposes, e.g. on t-shirts and the like.*
   -

Use of a name which includes the letters BUNTU in relation to computer
   hardware or software.
   -

Services relating to any of the above.

If you wish to have permission for any of the uses above or for any other
use which is not specifically referred to in this policy, please email us at
trademarks AT ubuntu DOT com and we'll let you know as soon as possible if
your proposed use is permissible. *Note that due to the volume of mail we
receive, it may take up to a week to process your request.* Permission may
only be granted subject to certain conditions and these may include the
requirement that you enter into an agreement with us to maintain the quality
of the product and/or service which you intend to supply at a prescribed
level.

-------------------------

** THEY STILL HAVE EXCEPTIONS ON THEIR RULES!! DON'T BE AFRAID!!*

* If we have any doubt, simply contact them at trademarks at ubuntu.com and ask
if we have took the right way or are we wrong.

I do strip others unrelated rules and condition due to it's not applicable
to us at all.

I hope nobody here are *afraid of* any rule or getting a red card (making
mistakes). I'm not afraid of rules because I will follow the rules as long
as it didn't harm me in any sense. Everything is negotiable and we are all
human being. Come on man, everybody made mistakes and we can avoid mistakes
if we look after each other.

*Keep up the good work guys!!!.... Cheers!!*

*
