I asked (the brilliant) Michael Geist (http://michaelgeist.ca/) the same 
question about a year ago and I believe he said it was similar to 
software patents in the EU, and that there were also some talk about 
changing to a US style system. Because of the fall of the liberal 
government I don't think anything happened. AFAIK nothing has changed 
since then.

So no I don't think they could sue anyone in Canada, but IANAL.
