Additionally, neither 2.6.38.8 nor 2.6.39.43 are Ubuntu kernel versions.
It sounds like you might be referencing the current and proposed kernel
versions, though - 2.6.38-8.42 and 2.6.38-9.43. If that's the case, you
should file a bug against the "linux" package in Ubuntu by running
"ubuntu-bug linux" on your machine. That will also collect additional
information that is necessary to even begin to debug any issues you are
seeing.

I'm going to close this bug; I'd recommend following the instructions
above to open a new one.
