As long as the modifications aren't going back, it's not Linux any more.
It's a fork of Linux.

Manufacturers and mobile operators are doing all kinds of dirty tricks to
prevent you from doing unofficial ROM upgrades, running software as root,
or in some countries choosing a different operator isn't even allowed or
supported.
