I don't think the idea was that "we" would need to launch a lawsuit, but 
that MS has been known to launch lawsuits specifically to quash little guys, 
so it would take someone with some legal clout to step up to the bat.  When 
you're MS, it doesn't matter if some court two years down the road dismisses 
their suit as frivolous, because by then they've bankrupted you.
