Colbert meant business about getting litigious:

Viacom has issued a DMCA takedown notice, hence "This video is no
longer available due to a copyright claim by Viacom International
Inc.."

This is extremely ironic, I really had a great laugh out of it. If the
Viacom employee issuing the takedown notice had watched the video, I
wonder what he/she would have thought.
