They don't need to. It's apparent. Go to dvdcca.org. They sell licenses
to use the patents involved in the process and assign you a CSS key for
unscrambling. They are an active body with active enforcement.

libdvdcss, if you read the README, circumvents this system by GUESSING
possible keys, and if that fails, using a brute force method. This
obviously wouldn't fly, and would provoke a lawsuit if it was
distributed.

The lawsuit would be justified for the same reason the MPAA won the
cease and desist order against DeCSS, DMCA, patent laws, etc.
