Nexenta OS (a/k/a GNU/OpenSolaris) borrows a bit "too much" from Ubuntu?

Interesting.  Any thoughts on the Nexenta-GPL Controversy?  From what
I've read what Nexenta is doing isn't permitted under the GPL.
