Well, testcase might be a big word for it but simply when I save the attached file and do 
LaTeX+DVItoPS+ViewPS
the TOC is not updated - ergo, latex is not invoked twice. Quick build again and the TOC is there - remove or add a section quick build and the TOC is still the old one...
I'm not quite sure if this is what you ment by 'test case', however.
