As stated in the commit log, the bug has been added by commit b9959fd3b0fa
("vti: switch to new ip tunnel code"), which has appears first in 3.12.
In fact, this patch does not change anything ;-)
But maybe the goal is just to align the code on the upstream to ease backport.
