You mean you took the Ubuntu source for that kernel right of the repository, and used its own config to build it and it failed?

If so, it is indeed a bug.  It's not unusual for kernels but fail to build under specific configuration, I've seen this in pristine kernels took from kernel.org.   But I don't think a build for a kernel of Ubuntu fail.

Are you sure the source you used is clean a nothing remain of the patch you tried to apply?  Are you sure the kernel/config match is correct?
