  Ubuntu 9.10 fails to boot from rEFIT

Status in grub package in Ubuntu:
  Invalid

Bug description:
  Binary package hint: grub

  This is ubuntu 9.10 beta5 dist-upgraded, on a MacBookPro dual booting
  with macosx 10.6.

  I am observing a strange pattern.

  First I resized macosx 10.6 partition to leave space for ubuntu.
  Then rebooted and installed rEFIT.
  Then rebooted and installed ubuntu from a CD (holding down c key to boot from CD).
  My partition table is as follows:

  196 mb rEFIT
  25 Gb MacOSX
  5 Gb FAT32 (my '/shelf' partition to exchange data from mac to ubuntu and back)
  10 Gb ext4  (my root '/' ubuntu partition)
  8 Gb linux-swap 
  10 Gb ext4 (my '/other' reserve partition)
  190 Gb ext4 (my '/home' partition)

  The MBR was installed on sd4, my root partition.

  After installation, ubuntu wouldn't boot from "Legacy partition 4", as
  rEFIT boot menu titles it.

  So I rebooted from the installation CD, opened GParted and realized my root partition was not labeled as "boot"-able.
  I added the "boot" flag to my root partition and rebooted: all ok!

  Rebooting any time worked.

  Then I run a dist-upgrade that updated the linux kernel and run, as
  part of the update process, the grub updater. The latter complained
  about not being able to update this type of partition or setup (I
  can't remember correctly) but stated it as a warning, and finished
  without error.

  After rebooting, I coudn't boot into ubuntu from rEFIT. I tried
  several times.

  So I rebooted from the CD, opened GParted, set the boot flag again --
  didn't do anything, since it was already there. Closed and rebooted,
  and voila, now I could boot again from rEFIT.

  So: there is some magic touch missing from the installation of a new kernel. Either at grub or elsewhere.
  I have seen the phenomenum two times already.
