I believe this was caused by the installer auto mounting the swap
partition, which kept the disk busy. This was fixed several years ago
since libparted no longer fails when an unrelated partition is in use.

Title:
installation using hard disk fails if using manual partition
Status in “ubiquity” package in Ubuntu:
Fix Released
Bug description:
Hi,
I am trying to do installation from hard disk using the method described here:
https://help.ubuntu.com/community/Installation/FromLinux
I have done this several time before with earlier releases.
I am using the Live CD (desktop installer) of alpha3 of Jaunty (9.04).
I already have an existing partition for the installation so that the installer should just format
that partition, without needing to do edit/change any existing partition).
I have chosen manual partition option. (My LiveCD image is on another partition
on the same hard disk).
However, the installation fails saying that it cannot sync the new partition
table to the disk because there are programs already using it.
I think the problem is that the installer is trying to edit the partition unnecessarily.
If a check can be added to execute the partition edit/change/sync only when really
needed, this problem would go away.
