I have found the source of the problem.
the solution was found here:

It seems that for HDDs larger than 2TB, they need to be explicitly set
to Partition table of GPT, and the current installer isn't able to do
this as well as not being able to setup the necessary partition of at
least 1.0MB with the flag 'biosgrub'
I had to use GParted (I used GParted Live CD) to set up the Partitions and the 1.0 Partition with no file system and the flag set to 'biosgrub' and then used the 12.04.3 Installer and it worked fine.
Once you get to the partitioner part, the necessary partitions are already set and you just do the RAID configuration,
add the swap and main partitions to the array, and set them up as - swap area, and ext4-mount point /(root) respectively.
No need for bootable flags.
Installer installs grub fine and all joy.
None of the tutorials hit this snag as they all use Virtual machines
with very small partitions.
Not sure whether this would still be classed as a bug
Maybe worth a mention in the Official Documents?

Bug description:
I have downloaded the Ubuntu 12.04.3 LTS 64-bit Server Installer today
and burned it to disk.
I am trying to setup a software RAID 1 array because the Installer doesn't recognise my Intel hardware RAID1 array
(brand new Gigabyte Motherboard.)
trying to follow many tutorials and the instructions of experts in the
Ubuntu Forums made me realise that the Installer has been changed
since all of the tutorials were written. A lot of options are
different or missing, or indeed added that weren't there originally.
When manually Partitioning,
When you create a new Partition, you are no longer given the choice of Primary or Logical, and there is now no way to set the Bootable Flag to "on"
This of course means the instal fails.
I believe there is no other way to do a software RAID1 instal than by
manually partitioning so that means you can now no longer do a
software RAID 1 instal of 12.04.3 LTS
I have discovered at least one other who has tried with a "new installer" and is having this trouble,

I have also read other people complaining about RAID1 setup failures
and many different ways of trying to manually instal grub after the
failed instal.
I think this should be looked into.
I can't find anywhere to report it as a bug.
