I am using Ubuntu 13.04 and it affects me as well.

  imagemagick import doesn't grab the visible screeen

Status in “imagemagick” package in Ubuntu:
  Incomplete

Bug description:
  I want to use the imagemagick "import" command to grab a rectangula area.
  It should return only the visible content of the screen, that is, the top most windows. But when there are many windows overlapping sometimes it doesn't work that way.
