Thank you for reporting this bug to Ubuntu. hardy has reached EOL
(End of Life) for this package and is no longer supported. As
a result, this bug against hardy is being marked "Won't Fix".

Bug description:
The following happens to me after I upgraded my vserver from dapper to
hardy today
# /etc/init.d/ssh restart
* Restarting OpenBSD Secure Shell server sshd [ OK ]
/etc/init.d/ssh: line 78: /proc/4366/oom_adj: Operation not permitted
