Hardy Heron Desktop has reached End-Of-Life and hence ubiquity in hardy is not supported.
Also non-lts releases do not have point releases with potentially updated ubiquity.
Lucid had it's last point release in february.
This means that actually we can only actually release fixes in precise &
quantal series only.
The bug report in itself is confusing because the original bug reporter
did not clearly state which image was used (LiveCD or Alternate). While
comment #1 mentions alternate cd only.
Can you please test this bug using a recent image (precise or quantal)
and file a bug using `ubuntu-bug ubiquity` for desktop/livecd. And if
possible to reproduce with server CD `ubuntu-bug debian-installer`.

Bug description:
During installation I selected a /boot partition which I had
previously setup. It contained a few files which I had carefully given
unique names so that Ubuntu wouldn't overwrite them. I instructed the
installer to NOT format the partition, but lo and behold upon reboot
it looks like it has!
This could have serious consequences if the same bug crops up for
other partitions.
This is in the latest LTS Desktop AMD64 installer CD ISO downloaded
from linux.citylink.co.nz.
I was expecting the installer to just dump the ubuntu kernel in to
/boot amongst the existing files. Instead it formatted the partition
THEN installed the kernel.
