Turns out I was looking at an old branch - this is fixed in r493 of

Status in “whoopsie-daisy” package in Ubuntu:
  Fix Released

Bug description:
  The debian/copyright file in whoopsie asserts that the files in the
  backend directory are licensed under the AGPLv3.

  Now that the source package has been split into separate packages for
  server/client, the backend/ directory is no longer present in the
  client source and the license assertion for backend/ should be
  removed.
