Thank you for taking the time to report this bug and helping to make Ubuntu better. 
I can't reproduce the issue on Ubuntu 12.04: Running "sudo ...&" just fails, because there is no way to enter the password (withouth using "fg" for getting the process back in the foreground) -- one should actually use "sudo -b ..." instead.

Could you please check whether sudo was really needing credentials and
was not just using the cached ones? Run "sudo -k" first, then repeat
your command -- it should do nothing, then when you do "fg" you should
see sudo waiting for your password.
