  LM10 CD x64 installer unauthorized format of FAT32 partition

Status in The Linux Mint Distribution:
  Invalid

Status in “ubiquity” package in Ubuntu:
  New

Bug description:
  LM10 x64, CD
  verified proper MD5
  properly burnt CD (CD integrity test passed)

  Installed to hard drive with existing good partitions,
  1 home [ext3]
  2 [ext3] for LM10
  3 [ext3]
  4 ext 
  5 [fat32]

  Manually selected partitions as mount points
  1 /home [format NO]
  2 / [format YES]
  4 /data [format NO]

  Mint installer did not give alert that it was formating partition 5,
  it did quickly scroll text that it was formating to ext3 despite
  format was NO

  I will provide installer log when I can
